Tai-Heng Cheng, senior legal advisor to Hoguet Newman Regal & Kenney, LLP, and tenured professor at New York Law School, specializes in international arbitration and litigation.

He is a member of the panels of neutrals of the AAA/ICDR, CPR and HKIAC, and has served as chair, arbitrator, counsel and expert in investor-state disputes and international commercial arbitrations, under ICDR, ICC, UNCITRAL, JAMS, SCC and ICSID rules. He has also served as counsel in multi-jurisdiction proceedings in the United States and abroad.

His recent engagements include:

• Counsel in a JAMS international arbitration on behalf of a foreign asset management company against a financial institution, winning full damages and 90% of fees and costs. 
• Counsel in an $400 mn. bilateral investment treaty arbitration between a mining company and an Eastern European state.
• Counsel in an $150 mn. ICC investor-state arbitration concerning a project agreement between a U.S. corporation and an African state. 
• Counsel in an ICC international arbitration concerning an airport project in the United States. 
• Counsel for a hedge fund against its former partner in an New York Court of Appeals case. 
• Counsel for a corporate executive in parallel lawsuits in New York, Atlanta, Singapore and the Cayman Islands.
• Counsel in an ten-week federal white collar trial and a subsequent appeal before the U.S. Court of Appeals for the Second Circuit.
• Co-Counsel in an UNCITRAL award vacatur proceeding in the Svea Court of Appeals in Sweden.
• Chair of an ICDR international arbitration in a franchise dispute between European and Latin American corporations. 
• Chair of a HKIAC international arbitration in a investment dispute between Chinese and Hong Kong entities, in proceedings in English and Mandarin.
• Co-arbitrator in an UNCITRAL international arbitration between U.S. and Hong Kong corporations. 
• Co-arbitrator in an ICC international arbitration in an intellectual property licensing dispute between Canadian and Japanese corporations. 
• Expert in international law in an investor-state ICSID arbitration. 
• Expert in international law in a $500 mn. SCC investor-state arbitration; 
• Expert in arbitration in a $4 bn. bankruptcy proceeding in Canada; 
• Expert on international law and U.S. law in Singapore court proceedings to extradite individuals for conspiracy to defraud the United States. 
• Amicus curiae in a U.S. Federal Court of Appeals case involving a $400 mn. dispute between a hedge fund and sovereign state. 
• Consultant to a Balkan state on matters of state succession. 
• Consultant to an Africa state on succession, oil concessions and expropriation.  

Prof. Cheng is also a tenured professor of law and co-director of the Institute for Global Law, Justice and Policy, New York Law School, where he has been since 2006.  He was a visiting associate professor at Vanderbilt Law School and City University of Hong Kong School of Law in 2010 and 2008, respectively. From 2003 to 2006, Prof. Cheng practiced law at Simpson Thacher & Bartlett, LLP.  U.S. Federal Appeals and District Courts have cited and relied on Professor Cheng’s international law scholarship as authoritative.

He is an elected member of the American Law Institute, the Executive Council of the American Society of International Law, and the Executive Committee and Academic Council of the Institute for Transnational Arbitration. He was co-chair of the 2011 American Society of International Law Annual meeting and is co-chair of the 2012 ITA Annual Arbitration Meeting in Dallas, Texas. He is also Honorary Fellow of the Foreign Policy Association and Fellow of the American Bar Foundation.

Prof. Cheng is admitted to practice before the courts of the State of New York, and the U.S. District Courts for the Southern, Eastern and Western Districts of New York, and the U.S. Court of Appeals for the Second Circuit.

He holds a Doctor of the Science of Law degree and a Master of Laws degree from Yale Law School, where he was Howard M. Holtzman Fellow for International Law. He also holds a Master of Arts degree and a law degree with first class honors from Oxford University, where he was Oxford University Scholar.
