Brad Nash Quoted in Law360 Insurance Authority on Coverage Dispute Tied to “It Ends With Us”
As litigation continues to unfold over allegations of sexual harassment on the set of “It Ends With Us,” Harco National Insurance Co. has filed suit seeking to deny coverage to the film’s production company under its D&O and EPL policies. The dispute centers on whether a letter sent by Blake Lively’s legal team months before litigation formally commenced triggered a duty to notify the insurer.

Brad noted that the insurer’s position “may be a stretch,” emphasizing the uncertainty that often surrounds the pre-complaint phase of employment disputes. “There can be a nebulous period before a formal sexual harassment complaint is filed,” he explained, adding that “more disclosure is probably better precisely to avoid this kind of issue.” Read his full thoughts here.
