HNRK Achieves Complete Victory for Policyholder Client
On March 26, Judge George Daniels of the Southern District of New York issued a complete victory for HNRK client Fabrique Innovations in connection with its claim for coverage under a marine cargo insurance policy after the theft of its merchandise. The court granted Fabrique’s motion for summary judgment on the issue of damages in the long-running action against Chubb, and awarded Fabrique its full claim for damages, which includes not just the value of its lost merchandise, but also the expenses it incurred attempting to recover the merchandise and prejudgment interest starting from when Federal Insurance Co. unjustifiably denied coverage.
