Randi spoke with Law360 about best practices for employers to avoid inadvertently increasing the regular rate of pay for non-exempt employees. Randi suggests that employers should manage non-exempt employees’ expectations by having a clear conversation or explicitly state the terms in writing to avoid implicit promises. “It sends a very bad message to the employee if an employer suddenly reduces the amount of a bonus or decides not to pay it because the employer is concerned about establishing a promise of pay,” she said.
