New York Appellate Division, First Judicial Department Affirms for GreenGate Fresh LLLP

Yesterday, New York’s Appellate Division, First Department handed down a decision affirming a summary judgment win for GreenGate Fresh LLLP in a product contamination coverage matter. The ruling affirmed the trial court’s holding that GreenGate’s losses arising from E. coli outbreaks in romaine lettuce were covered under the policy’s Government Determination Endorsement, even though government investigators were unable to trace the source of the outbreak to GreenGate’s facility.
