Second Circuit Affirms $2 Million Complete Victory for HNRK Client Fabrique Innovations
HNRK Partner Joshua Blosveren and Associate Steven Silverberg secured a complete victory in the United States Court of Appeals for the Second Circuit on behalf of client Fabrique Innovations in connection with its claim for coverage under a marine cargo insurance policy after the loss of its merchandise.
The summary order affirms the earlier win in the Southern District of New York that granted Fabrique’s motion for summary judgment on the issue of damages in the long-running action against Chubb, and awarded Fabrique its full claim for damages, which included not just the value of its lost merchandise, but also the expenses it incurred attempting to recover the merchandise and prejudgment interest starting from when Federal Insurance Co. unjustifiably denied coverage.
